Oklahoma social media addiction lawsuit

Families in Oklahoma are holding Meta, TikTok, Snap and YouTube responsible for harm to their children, one case at a time. Here is who may qualify, how Oklahoma cases are filed, and the deadline that applies.

Quick answer

Oklahoma families can bring individual claims, not a class action, against Meta, TikTok, Snap and Google (YouTube) when a child was harmed after heavy use before 18. In Oklahoma, an injury claim generally must be filed within 2 years; a person under a legal disability when injured, which includes children, generally has one year after the disability ends (around age 19) to file. Medical malpractice claims follow stricter rules. A free review checks your family’s deadline.

Who may qualify in Oklahoma

  • The child lives or lived in Oklahoma and used Instagram, Facebook, TikTok, Snapchat or YouTube regularly before 18
  • The child developed depression, anxiety, an eating disorder, self-harm, sleep problems or another serious harm
  • No diagnosis? 20 or more hours a week on one platform before 18 may support an exposure claim
  • Families of a young person who died by suicide after heavy social media use
  • An adult contacted the child through a platform and pressured, threatened or exploited them

Oklahoma filing deadlines

Personal injury / product liability2 yearsMost injury claims must be filed within 2 years.12 O.S. § 95(A)(3)
Injured as a minor—A person under a legal disability when injured, which includes children, generally has one year after the disability ends (around age 19) to file. Medical malpractice claims follow stricter rules.12 O.S. § 96
Wrongful death2 yearsA wrongful death claim must be filed within 2 years.12 O.S. § 1053(A)

§ 96 does not use the word 'minor' in its general rule. It says 'legal disability,' and Oklahoma courts treat minority as one. It is unclear from the text whether a child gets the later of age 19 or 2 years from the injury. The wrongful death statute does not say when the 2 years starts; courts generally count from death. The official OSCN site blocked access, so only Justia's 2025 edition was checked. No general product-liability outer time limit was found.

These are the general rules in the statutes. Courts apply exceptions, and which rule applies depends on the facts, so a lawyer should confirm your family’s deadline. This is general information, not legal advice.

How Oklahoma cases are filed

This is not a class action. A Oklahoma family’s claim is filed in the child’s name. Federal cases from every state are grouped in MDL No. 3047 in Northern California so evidence and pre-trial rulings are shared; about 3,800 were pending in October 2026. Some cases are filed in state court instead. The lawyers decide with your family where your case belongs.

What Oklahoma has done

Oklahoma's attorney general filed a separate lawsuit against Meta in Oklahoma state court on October 24, 2023, under the Oklahoma Consumer Protection Act. It is one of eight suits filed in state courts outside the joint federal case. The suit says Instagram and Facebook were built to be addictive to kids and that Meta misled the public about the dangers.

Lawsuits and laws by the state are separate from a family’s own claim. They do not file or replace a claim for your child.
